A legal conflict has developed between two established spice brands over the design and presentation of ground black pepper packaging. Watkins Inc. has filed a federal lawsuit against McCormick & Co., claiming that recent packaging changes may give customers a misleading impression about the amount of product they are receiving.
The lawsuit alleges that McCormick reduced the contents of its pepper containers from 8 ounces to 6 ounces while continuing to use containers that appear similar in size. Watkins argues that this type of packaging practice, sometimes known as slack-fill, could cause shoppers to believe they are purchasing the same quantity as before.
The companies use different approaches when packaging their products. McCormick’s containers are not transparent, making it difficult for customers to judge the amount inside by appearance alone, while Watkins uses a smaller container for a comparable amount of pepper. McCormick has stated that its packaging follows applicable labeling rules and that the net weight information is clearly provided on the product.
The lawsuit follows other consumer-related claims involving the packaging that are also moving through the legal system. The matter remains unresolved, and no final decision has been reached.
The dispute draws attention to the role packaging and labeling play in consumer choices. It also serves as a reminder that checking product weights, measurements, and labels can help shoppers better compare options and understand what they are buying.
